2.2 User Roles and Access

The Platform supports three distinct user categories:

Experts/Consultants:

• Professional registration and profile creation
• Project discovery and application
• Access to benchmarking tools and virtual AI
• Client interaction and project delivery

Project Owners/Individuals:

• Project creation and posting
• Expert hiring and management
• Project oversight and collaboration
• Access to benchmarking and virtual AI tools

Organizations (Public and Private):

• Corporate account management
• Multi-user access and administration
• Enterprise-level project management
• Full platform feature access

3.1 Account Creation

To access Platform services, you must:

• Provide accurate and complete registration information
• Maintain and update your information as needed
• Choose a secure password and protect account credentials
• Verify your identity as required by UAE and GCC regulations

3.2 Account Responsibilities

You are responsible for:

• All activities conducted through your account
• Maintaining the confidentiality of your login credentials
• Immediately notifying us of any unauthorized access
• Ensuring compliance with these Terms and applicable laws

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms or Platform policies
• Fraudulent or illegal activities
• Non-payment of fees or charges
• Threat to Platform security or integrity
• Regulatory or legal requirements

4.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will:

• Provide accurate and truthful information
• Respect intellectual property rights
• Maintain professional conduct and communication
• Comply with all applicable UAE and GCC laws

4.2 Prohibited Activities

You must not:

• Use the Platform for illegal or unauthorized purposes
• Impersonate others or provide false information
• Engage in harassment, discrimination, or abusive behavior
• Upload malicious software or harmful content
• Attempt to breach Platform security measures
• Interfere with other users' Platform experience
• Extract or harvest data without authorization
• Use automated tools to access the Platform without permission

4.3 Content Standards

All content you submit must:

• Be accurate and not misleading
• Respect others' privacy and rights
• Comply with professional standards
• Not contain offensive or inappropriate material
• Not infringe intellectual property rights

5.1 Professional Qualifications

Experts and Consultants must:

• Possess genuine professional qualifications and experience
• Provide accurate credentials and work history
• Maintain professional certifications and licenses
• Comply with applicable professional standards and codes of conduct

5.2 Service Delivery

When providing consulting services, you agree to:

• Deliver services with professional competence
• Meet agreed timelines and deliverables
• Maintain client confidentiality
• Provide regular project updates and communication

5.3 Expert Ratings and Reviews

• Client feedback and ratings may be publicly displayed
• You may respond to reviews in a professional manner
• False or misleading reviews are prohibited
• Disputes regarding reviews will be handled per our dispute resolution process

6.1 Service Scope

Experts shall provide services as described in the applicable project agreement between the Client and the Expert.

6.2 Expert Selection and Hiring

Clients are responsible for selecting, hiring, and contracting with Experts. Payment terms must be agreed upon before project commencement.

6.3 Expert Responsibilities

Experts are responsible for delivering services in accordance with the agreed specifications, timelines, and quality standards.

6.4 Client Responsibilities

Clients must provide necessary information, access, and cooperation to enable Experts to perform their services effectively.

8.1 Fees and Charges

Fees for Expert services are determined by agreement between the Client and the Expert. The Platform may charge service fees as specified in the payment terms.

8.2 Payment Processing

Payments between Clients and Experts will be facilitated through the Platform’s payment system. Payment disputes must be reported within 30 days of the disputed transaction.

9.1 Platform IP

The Platform and all related intellectual property, including but not limited to trademarks, content, software, and design, are the property of the Platform operator or its licensors.

9.2 Project IP

Ownership of intellectual property created during a project shall be determined by the agreement between the Client and the Expert.

10.1 Privacy Compliance

The Platform’s collection, use, and disclosure of personal data are governed by the Privacy Policy, which is incorporated into these Terms by reference.

11.1 Service Availability

The Platform aims to provide continuous service but does not guarantee uninterrupted or error-free operation.

11.2 Maintenance and Downtime

Scheduled maintenance and updates may result in temporary service unavailability.

12.1 Platform Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

To the fullest extent permitted by law, the Platform operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly.

14.1 Governing Law

These Terms are governed by the laws of the United Arab Emirates and applicable GCC regulations.

14.2 Dispute Resolution Process

1. Direct Negotiation: Parties must first attempt good faith negotiations
2. Mediation: If negotiation fails, disputes will be submitted to mediation
3. Arbitration: Unresolved disputes will be settled by binding arbitration
4. Court Jurisdiction: Final recourse is to competent UAE courts

14.3 Arbitration Rules

• Arbitration will be conducted under UAE arbitration laws
• Seat of arbitration will be Dubai, UAE
• Language of proceedings will be English
• Single arbitrator unless parties agree otherwise

15.1 Termination by User

You may terminate your account at any time by:

• Using account deletion features
• Contacting customer support
• Following prescribed termination procedures

15.2 Termination by Company

We may terminate accounts for:

• Material breach of these Terms
• Illegal or harmful activities
• Non-payment of fees
• Extended account inactivity
• Business or regulatory reasons

15.3 Effect of Termination

Upon termination:

• Access to Platform services ceases immediately
• Outstanding obligations remain enforceable
• Data retention follows our Privacy Policy
• Certain provisions survive termination

17.1 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and ThinkTankX AI.

17.2 Amendments

We may modify these Terms at any time by:

• Posting updated Terms on the Platform
• Providing notice through email or Platform notifications
• Requiring acceptance of new Terms for continued use

17.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17.4 Assignment

• You may not assign your rights under these Terms without our consent
• We may assign our rights and obligations without restriction
• These Terms bind successors and permitted assigns

17.5 Waiver

Failure to enforce any provision does not constitute a waiver of our rights to enforce such provision in the future.

17.6 Language

These Terms are prepared in English. In case of any conflict between English and translated versions, the English version prevails.
